1. Acceptance of Terms

By accessing or using the Discreet Ketamine website, mobile applications, and telemedicine services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and Discreet Ketamine, including its affiliated entities DiscreetKetamine Florida LLC and DiscreetKetamine New Jersey LLC (collectively, "we," "our," or "us").

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be a resident of Florida or New Jersey
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information during registration
  • Have a valid government-issued photo ID for identity verification
  • Not have any contraindications to ketamine therapy as determined by our physicians

3. Medical Services

3.1 Nature of Services

Discreet Ketamine provides telemedicine consultations with licensed physicians for the evaluation and potential treatment of anxiety, depression, PTSD, and chronic pain using ketamine therapy. Our Services include:

  • Telehealth video consultations with board-certified physicians
  • Medical evaluation and treatment planning
  • Prescription of compounded ketamine medications when appropriate
  • Ongoing monitoring and follow-up care
  • Access to our session support platform

3.2 Not Emergency Services

Our Services are not intended for medical emergencies. If you are experiencing a medical emergency, suicidal thoughts, or are in crisis, please call 911 or go to your nearest emergency room immediately. You may also contact the National Suicide Prevention Lifeline at 988.

3.3 FDA Disclaimer

Important: Compounded ketamine for anxiety, depression, PTSD, and chronic pain is not FDA approved. Individual results may vary. Ketamine therapy is not appropriate for everyone.

3.4 Peer Support Requirement

A peer support person (sitter) is required to be present during all at-home ketamine treatment sessions. This person must be a responsible adult who can assist you if needed and remain with you throughout your session.

4. User Responsibilities

You agree to:

  • Provide accurate, complete, and current information about your health history
  • Disclose all medications, supplements, and substances you are taking
  • Follow all treatment instructions provided by your physician
  • Have a peer support person present during treatment sessions
  • Not drive or operate machinery during or after ketamine sessions
  • Attend scheduled appointments or cancel with appropriate notice
  • Report any adverse effects or concerns promptly
  • Keep your account credentials secure and confidential
  • Not share your medication with others
  • Store medication safely and securely

5. Fees and Payment

5.1 Consultation Fees

Our physician consultation packages are priced as follows:

  • 1 Month: $250 (includes two 30-minute telemedicine visits)
  • 3 Months: $650 (includes six 30-minute telemedicine visits)
  • 6 Months: $1,200 (includes twelve 30-minute telemedicine visits)

5.2 Medication Costs

Ketamine medication is dispensed by our partner compounding pharmacy and billed separately. Medication costs typically range from $50 to $130+ per month depending on dosage and quantity prescribed.

5.3 Insurance

Our Services are not covered by medical insurance. We accept all major credit and debit cards. You may be able to use HSA/FSA funds for eligible expenses.

5.4 Refund Policy

Consultation fees are generally non-refundable once services have been rendered. If you are determined to be ineligible for treatment during your initial consultation, you may be eligible for a partial refund. Please contact us to discuss your specific situation.

6. Prescriptions and Pharmacy

Prescriptions are issued at the sole discretion of our licensed physicians based on their medical judgment. We cannot guarantee that you will receive a prescription. Prescriptions are sent to licensed compounding pharmacies that will ship medication directly to your address.

You are responsible for ensuring someone is available to receive and sign for medication deliveries. Medications must be stored according to pharmacy instructions.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, software, and the overall design, are owned by Discreet Ketamine and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Discreet Ketamine and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  • Your use or inability to use our Services
  • Any unauthorized access to or alteration of your data
  • Statements or conduct of any third party
  • Any other matter relating to our Services

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free. We make no warranties regarding the results of treatment, as individual responses to ketamine therapy vary.

10. Indemnification

You agree to indemnify, defend, and hold harmless Discreet Ketamine and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our Services, violation of these Terms, or infringement of any rights of another party.

11. Termination

We may terminate or suspend your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use our Services will immediately cease. We will provide appropriate medical transition assistance and records as required by law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be resolved in the state or federal courts located in Palm Beach County, Florida.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of our Services after any changes constitutes acceptance of the new Terms.
